Nektar Technology, Inc. respects and protects your privacy. We are committed to acting in accordance with the respective legal regulations such as the EU General Data Protection Regulation (GDPR) and EU-US Privacy Shield Principles and will only collect, process and store data with your prior consent and to the extent required, to provide our services to you. 

We collect two types of information: 
Direct information you actively provide to us.
Indirect information gathered through aggregating tracking information from the use of our website (“cookies”). 

The following declaration provides an overview of what data is requested on our website, how we use this data, in which way you can receive information about data you have provided to us and the security means we take to protect your data.

Direct information you actively provide to us

In order to provide our services to you (including but not limited to access to downloadable software, updates or product support), we require you to provide us with personal information by filling in forms on our site. We collect information:

• When you buy our goods online (account information, e-mail, contact details) 
• When you sign up for our newsletter or create a user account (e-mail, contact details)
• When you register a product for the purpose of software delivery and support (product details, purchase history, e-mail, contact details)
• When you contact our support via our website (e-mail, name, subject, communication)
• When you take part in any of our campaigns or surveys (e-mail, contact details and other data as specified in the special terms for the campaign)

To submit your information, you are required to click an “Accept”, “Submit”, “Buy” or similarly named button, through which action you give us permission to store and use your data. We do not collect direct information without your explicit consent, if a form for example is abandoned prior to the submission of data.

Indirect information we may collect from you

When you visit our website, we may automatically collect site usage data from you using standard internet technologies. This is solely done for internal and statistical purposes in order to optimize our website and services. This includes: pages viewed, system information such as browser, operating system, device, querying domain, search engines used, names of downloaded files, date and time of access and your IP address. For usage data collection we are using Netsuite’s internal web analysis tool and “Google Analytics”.

Use of Cookies

“Cookies” are small text files stored on your computer, sent by the web server to your browser in order to optimise your user experience. They can only be read by the server that has previously placed them. They contain information about your use of our website as specified in the last section. Cookies only identify a computer’s IP address and do not contain any personal data such as a name. You can manage the use of cookies in your browser’s settings or options menus, this includes the ability to not accept any cookies from our website. Access, correct, update or delete your personal information

When you opt-in to use our services you have accepted our Privacy Policy as well as accepted our Terms and Conditions. We provide you with the opportunity to opt-out at any time or have your personally identifiable information removed from being used or disclosed for certain purposes. You can manage contact preferences and details (as well as opting out of our newsletter) in the Nektar user account’s preferences at any time by logging into your account and changing the corresponding settings. 
Please note, that you need a user account in order to register your product and be eligible for software downloads and updates as set forth in the software license agreement that came with your product. How we use your data

A great user experience can only be achieved by understanding how our website and products are used. 
To help the process we collect data to: 

• Understand which web pages are useful and which need improving. 
• Deliver on your request to get regular information about our products and services. 
• Provide an effective setup service when products require software downloads and supporting files. 
• Enable us to contact you with information about updates. 
• Allow you to authorize a software product according to our terms and conditions for that product. 
• Provide our technical support with as much upfront information as possible, to help answer your questions efficiently and fast. 
• Processing of orders, payments and delivery of goods through our store. 
• Comply with applicable laws.

Sharing Personal Data with Third Parties

We do not transfer your data to a 3rd party, unless we are required to do so in order to process payment, deliver an order or comply with a legal inquiry that forces us to do so.

International Data Transfers

Our services are available internationally. So your use of our services may involve storage, processing and transfer of your date between any of the countries in which we operate in accordance with this Privacy Policy. By using our services, you authorize us to use the information collected about you in this way. This may include transfer to countries outside of the United States or the European Union with a different level of protection for such information.

Security measures to protect your data

We have taken a variety of security measures to protect personal information to the extent that it is required and reasonable. We use Oracle Netsuite as a single database for all data, so there is no transfer between systems that potentially could prove vulnerable to hacking or interception of data. 

Netsuite is a Safe Harbor Organization. As a US based corporation doing business globally we have a responsibility to provide the best security of personal data possible and Netsuite’s adherence to the EU-US Safe Harbor Privacy Shield Principles is key when it comes to the safe transfer of personal data between EU and US. It delivers big company security that would not normally be accessible to a company of our size. 

Access to data is limited to authorized persons pursuant to this privacy statement. Only staff that are trained in matters of security and data processing processes and that require information to complete a special task (such as support or completing an order) have access to personal information. 
Please note, that we can not guarantee complete data privacy when communicating via email.

Analysis tools and advertising

Google Analytics

This website utilizes functions of the web analysis service Google Analytics, a service of Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA), using your anonymized IP address as part of a contract processing agreement.
The IP anonymization is carried out by Google within the EEA. According to Google, only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. Google states in addition that the IP address transferred by your browser will not be merged with other data by Google. By means of Google Analytics, the following data about the use of our website is processed:

⦁ approximate location at the level of a region
⦁ anonymized IP address
⦁ technical information about the browser and device used (e.g. language setting, screen resolution)
⦁ Internet provider of the user
⦁ which website/advertising medium a user used to access this website
⦁ the pages accessed by the user
⦁ whether users perform certain actions on our website, so-called conversions, such as the purchase of a product newsletter subscriptions, downloads, purchases)
⦁ user behavior (e.g. which links are clicked on, how long a user stays on a website, from which website the user leaves our website).

We have deactivated the features in Google Analytics that would allow Google or another third party to use data as the responsible party. No personal profiles are created; the corresponding statistics only contain summarized data that do not allow any conclusions to be drawn about a specific person.
The reports created by Google Analytics allow us to understand how our website is utilized and to determine the success of advertising measures. This allows us to optimize our website (in particular its structure, content, features) and advertising measures and thus our business success. The legal basis of the processing is based on your consent Art. 6 para. 1 lit. a) GDPR.
In Google Analytics, we have set a storage period of 14 months for the personal data concerned. The deletion of data whose retention period has been reached takes place automatically once a month.

Browser Plugin

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website.

Subprocessors

As part of the processing of personal data, Google is entitled to commission subcontractors. A list of these subcontractors can be found at https://privacy.google.com/businesses/subprocessors/.
Within the scope of the activities of Google Ireland Limited, there may be an export of the data to a third country within the meaning of Art. 44 GDPR. The legal basis for this, pursuant to Art. 46 (2) c), are the so-called standard contractual clauses that we have concluded with Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Objection to data collection

Plugins and tools

Google Maps

This site uses the map service Google Maps via an API. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
To use the functions of Google Maps it is necessary to store your IP address. This information is usually transferred to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer.
The use of Google Maps is in the interest of an attractive presentation of our online offers and to make it easy to find the places we have indicated on the website. This represents a legitimate interest in the sense of article 6 section 1 letter (f) of the GDPR.

Facebook

Our website has links to our Facebook page but we have not implemented any plugins provided by Facebook. Clicking on a link will take you directly to our Facebook page. None of your data is transferred to Facebook as a result of our links to Facebook.The sole responsibility for Facebook and its website lies with Facebook Inc., 1601 S. YouTube

Our website has embedded YouTube videos as well as links to our YouTube page. None of your data is initially transferred to YouTube as a result of our links to this service.If you click on a YouTube link, you will be taken directly to the corresponding YouTube video. Personal data is only transmitted to YouTube if you are logged into your Google user account on the device you are using. In this case, YouTube will be informed that you have visited our website. Children

This website and its services is not directed at individuals under the age of 16. Retention of Data

We only store information about you in order to deliver the services you requested. Once the collected information is no longer needed for this purpose, it is deleted from our servers. Site security

We take privacy and confidentiality seriously, that’s why the nektar.online web site uses 256-bit SSL encryption via Secure HTTP (https:) pages anywhere that private information or credit card data is required to be submitted by a user of the site. 

When you register with the nektar.online site (or become a subscriber or shopper) you create a unique My Account record for yourself. All transmission of sensitive data to and from the nektar.online site (such as when you update your My Account information, buy something in our Shop, change passwords, address details and such-like) takes place within a secure, 2048-bit encrypted, environment. Your browser should display a locked/closed padlock icon in its status bar whenever Secure HTTP connections are being used. Where forms are used for you to submit data to the site, the locked padlock helps you identify such pages. PC users may verify the security of any web page by right-clicking on such pages and selecting “Properties” from the pop-up menu. The resulting window explains what level of encryption is being used on that page.
